Bisard Found Guilty On All Charges
An Allen County jury has returned a guilty verdict on all charges the Marion County Prosecutor's Office filed against former IMPD Officer David Bisard in connection with the 2010 fatal alcohol accident he was involved while driving his police cruiser that left one motorcyclist dead and two seriously injured. Bisard faces a maximum sentence of 54 20 years in prison and fines of up to $90,000 for the 9 felony charges against him. Sentencing in the case is set for November 26 according to WRTV.

This Prosecution team did a nice job. Yeah, I know that the Defendant likely will appeal and that will extend the case for another couple of years.
Good. He might meet some bikers in jail.
Now we need the federal prosecution against levels of the police department and prosecutor's office.
Hopefully, the FOP won't waste its money on his appeal.

several of his convictions will have to be merged because they were based on the same evidence. It appears that his maximum sentence is 28 years.
The 54-year maximum was what WRTV was reporting. I thought that sounded excessive. I would guess some of those sentences would be served concurrently as well.
I also heard Jack Crawford say on WTHR that he guessed Bisard would probably wind up with somewhere close to a 10-year sentence.
Ten years for the B Felony (IC 35-50-2-5)with mitigating circumstance. All other counts to be served concurrently. Serves 5 years, getting 2-for-1 for good behavior with 5 years probation upon release...if I were a gambling man. The State gets their pound of flesh. Anything more is just excessive and outside the sentencing norm.
Would a citizen who killed a cop only get ten years?
Remember, Bisard has another DUI case pending that caused his bond
in this case to be revoked pre-trial here.
Actually, a drunk driving citizen who killed an IPD police officer only got 8 years. On August 17, 1993, Elvis L. Lacy struck and killed on-duty IPD Officer Teresa Hawkins. He had a BAC of .191 when he crashed into Officer Hawkins' marked police vehicle. He was found guilty of three class C felonies and served 8 years. Bisard was convicted of a class B felony and thus that is why I believe he will be sentenced to the 10 years with all others years to be served concurrently.
