That old, inoperable Buick Riviera city inspectors have been on City-County Councilor Patrice Abduallah (D) for more than a year to remove from his "residence" is still there. An avid AI reader stopped by Abduallah's neighborhood this morning and captured these two photos of the rear side of the residence from an alley behind the home. The public is still awaiting answers from Councilor Abduallah on his current residence. He has claimed this home as his residence, which has been undergoing complete renovation for more than a year and has encountered numerous building code and zoning problems and, by all indications, is not currently occupied. According to the City-County Council's website, he lists an address at 1144 N. Warman Ave. as his address, but that home is in Councilor Marilyn Pfisterer's district according to the district finder database on the CCC's website. State law requires a councilor to live in his district at least two years prior to taking office. If he moves out of the district to which he has been elected, he is required to resign his seat.

Patrice allegedly operates a catering kitchen with his wife. That's what he told me a year ago.
If someone is pulling permits for a remodel, (s)he has a definitive period of time to complete them and apply for a Certificate of Occupancy, or the remodel permits must be resought. The maximum timeframe, I believe, is a year.
It's not like DMD has never seen this scam before. They have safeguards to make sure someone doesn't work on a home for a decade, and claim it as his address. There are assessment implications, too, and if Center is doing its job (a BIG if), the permit applications are automatically linked to the township assessor.
Junk cars are a huge Indy problem. I have reported several in my neighborhood to the Mayor's Action Line. In each instance, within a week, the inspectors came and cited the homeowners.
My observation is, that one or two of these in a neighborhood, unchallenged, soon leads to eight or ten. It's a nuisance, and, in some cases, a health hazard. God knows what lives in those abandoned vehicles. They're eyesores and Patrice is minimally guilty of being a bad neighbor.
Well known in his neighborhood? I have a friend who lives 1 1/2 blocks away, for over 7 years and has never heard of Patrice.

This might be a Wilson question: If a person claims they live at a home _and_ the government indicates the home is a rental, can one claim the homestead property tax exemption? I was under the impression it had to be the primary residence and not a business property (to me, renting property is a business).

People claiming a rental home they own as their personal residence is one of the most common forms of tax fraud. You can only claim one. Karl Rove got caught claiming 2 home exemptions--one for his D.C. home and another in Texax.
A "rental" can't be used for a homestead exemption, which this place does. But can anybody prove it was rented? A casual observation by somebody at DMD wouldnt necessarily cut it. Who was the tenant? Anybody got rent receipts?

FACT: the house he used to live in that is in his district has utilities disconnected and does not have a residence permit (required because of all the work he has attempted to have done on it). this is not a mailing address versus actual residence thing. are his votes valid since is is not in compliance with the law?

I want to point out that there are a number of Democrats in this town who have spoken approvingly of my raising this issue about Abduallah's residency. They believe he is a poor councilor, and they would like to see him leave the council and replaced by someone capable of doing a good job.
Again, playing Devil's Advocate, having a tenant at that address in 2001 proves nothing. Abduallah first ran in 2003. Was he residing there in 2003? Disprove it!

I was thinking the law for the city council members mirrored the constitution. I stand corrected. The statute is all over the board on residency requirements depending on which local office you are seeking.
The usual procedure to resolve a residency dispute in an election year is to take it to the voters but this year, the GOP (and Libertarians) didnt put up any opponent to Councilor Abduallah. He is thus automatically re-elected.

Abdullah is about as shady as they come. There were already residency questions when he ran in 2003. His Libertarian opponent filed a complaint with the Marion County Election Board because he misreported about $10k in campaign donations. The alligations were found to be true. Had it gone to the prosecutor, he could have faced a felony. Instead, they fined him $100.
The Star referred to him as "a community leader" on the sole basis that it was his JOB to help people find public housing. I don't think that he does much leading when he's not getting paid. Have even heard that he's asking other councilors for personal loans.
Unfortunately, he runs in an 84% Democratic district. The Libertarian candidate came close to carrying a couple of precincts in '03, but there were several precincts that went 100% Democrat. It's tough to dislodge someone with those numbers.
The biggest shame in all of this: that's a '68 or '69 Riviera. Fixed up, that's an exceptionally valuable, cool car.

Elections aren't a solution to anything when 1) the candidate isn't qualified 2) the electorate doesn't have any alternative choices. Both problems appear to exist here.
It isn't my job to prove Abdullah lives in his district. It is his job. The fact that Abdullah doesn't want to confirm his residency isn't a good sign.
What I know about this situation is what I have read on this site. It brings to the fore the very issue however of party politics, both republican and democrat (one candidate only presented). It also reinforces the old saying; "You are identified by those with whom you associate". It is sad that with this situation, along with the Monroe Gray situations mentioned, that the local democrat party has not taken a hard stand for integrity. Forget about republican transgressions, this is an issue at hand. It defines our current democratic leadership. Unfortunately, it leads one to the definition of....corruption. This is not about judgement. It is not about mistakes. It is about integrity.

(B) a candidate on the ballot for the office sought by the person described in subsection (a).
(e) The candidate vacancy shall be filled under IC 3-13-1.

(1) falsely makes or fraudulently defaces or destroys a declaration of candidacy, request for ballot placement under IC 3-8-3, certificate or petition of nomination, recount petition or cross-petition, contest petition, or certificate of candidate selection, or a part of the declaration, request, petition, or certificate;
(2) files a declaration of candidacy, request for ballot placement under IC 3-8-3, certificate or petition of nomination, recount petition or cross-petition, contest petition, or certificate of candidate selection, knowing any part thereof to be falsely made;
(3) refuses to execute a certificate of nomination or candidate selection when required by this title to do so and knowing that the candidate has been nominated or selected;
(4) if the document is listed in subdivision (1), refuses to:
(A) receive the document; or
(B) record the date and time the document was received;
when presented in accordance with this title; or
(5) suppresses a declaration of candidacy, request for ballot placement under IC 3-8-3, petition or certificate of nomination, recount petition or cross-petition, contest petition, or certificate of candidate selection, that has been duly filed, or any part of the declaration, request, petition, or certificate;
commits a Class D felony.
IC 3-8-2-23 is moot since the date of withdrawal has past. It seems to me to read that the removal by county chair can only be done before the legal withdrawal date.
IC 3-14-1-1 is so broad that it seemingly covers about any election paperwork sin...
If a candidate falsifies his residence on his declaration of candidacy, it is a violation for "falsely making" a declaration. That's a Class D felony. As I said, the appropriate person to act here is Mike O'Connor with some friendly pursuasion from Mayor Peterson. Do they stand for integrity or not? If not, it's just another reason the voters of Indianapolis have for ousting what has clearly become a corrupt, incompetent and out-of-touch administration.
